Hi guys !

This summer i wanna tour with 2 famous dj's that made a 'disney' mixtape.
Massive mashups and remixes of famous disney songs mixed with famous electronic music. We would like to use Disney movies too.
We have like 10 loops from 3-5 seconds each from 3 different movies.

Does anybody knows how this is legal or illegal to use them ?
I asked a company in Belgium and they said I would have to pay 1 euro per visitor of that night. Crazy because we will be playing in rooms with 2000 people. That would be 2000 euro , I dont think anybody is gonna pay 2000 euro + fee ?!

Anybody can help me with this ?

Copyright laws are the natural enemy of culture.

One euro per head (or something like that) will be assuming you can get permission. Disney could possibly sue your arse for using any of it at all (for any reason)!

Copyright law is sometimes referred to as the Mickey Mouse law, because every time it looks like Disney's legal stranglehold on Mickey Mouse is coming to an end, the length of copyright privileges magically increases. Fuckers!

What about making parody material of Disney stuff? That will make much better legal use (fair usage). Why does it have to be the original work?!!? Create your own and you will be freer to do as you want. Make them out of lego or plasticine or 3d models. Be creative. It sound like you only want/have 30-50 seconds of footage to create.

Personally I wonder who said they have the broadcasting rights for Disney stuff in Europe? And it does sounds far too cheap are they official distributors/public performance rights management for Disney works? How did you break this cost down? Disney are know to be the strongest protectors of their own copyrighted works. Get some official documentation if you go down this route.

Copyright laws are the natural enemy of culture.

Why when I read comments like that do I think most VJ are void of any creativity at all. Make new culture! There are few borders now with the Internet to show your work. Be the new trendsetters.

Copyright can protect original artists too. Infact it is all we have got.

why forget it?

did the DJs get permission from Disney for their audio remixes? (i'm pretty sure they didn't as Disney wouldn't grant remix rights) so the audio is going to be illegal anyway, at which point you might as well just sample some of the videos illegally to go with the illegal audio samples.

YouTube - coldcut live eurokennes beats and pieces pt2
2:45 onwards, coldcut have been playing this track live for over 10 years without any legal threats from Disney, it is very unlikely that you'd get into trouble for some video sampling..

if you were to get in trouble the first thing that you would get would be a cease and desist letter telling you to stop playing the samples, if you stop as requested it is very unlikely that any further action would be taken..

If you pay 'Sabbam' you may play anything you want downloaded on iTunes , so I think the music is pretty legal. And yeah you're maybe right ...
hmmm i'm gonna think about it .... thanks sleepy tom , you're always a good information desk :D

Is that two wrongs make a right? :)

I agree though you are unlikely to get caught but legally I don't see any formal way to do this.

I don't understand 'Sabbam'. I am pretty sure anything you download on iTunes, etc is not for public performance. There AFAIK no (reasonable) model film sampling.

i agree with sleepy tom, anyday is a good day to be a pirate !! arg!!!

just be thankful your not in Orlando, where i have had a Disney reps tell me to not to play clips sampled form the Disney archives. Mind you this happened at a Disney sponsored event.

but if you can get away with it do till you can't no more.

Sabbam is the organisation in Belgium that you need to pay if you wanna dj copyright music. They have many agents that visit party's to personally check the dj's. You may play music from iTunes if you pay a fee. Yeah I know it's sounds crazy , but hey ... it's BELGIUM ! Everything is weird arround here !
(except child porn :s )

It is almost impossible to create anything new. I use almost exclusively my "own" content (mainly clips from my own camera), but even that is by "sampling" the world around me, which includes, of course, a multitude of things made by other people, and very possibly all kinds of infringements. With the (possible) exceptions of hand-made art/illustration, you are always copying something that someone else made or did.

Copyright is not your friend. Copyright is the friend of the people with lots of money, because in the end it comes down to suing people, not anything to do with fairness. Disney have lots of money and fancy lawyers, so they can make more money suing the pants off people. (Not to say they do make money out of that - maybe they do, maybe they don't - the point is that they can).
